User Content Permission Terms

We love hearing from you and seeing what you share. These User Content Permission Terms, together with our Privacy Policy and Terms and Conditions, apply when you upload content (such as photos, videos, reviews, or testimonials) to our website, tag our brand or use our hashtags on social media, or respond to a request by us to feature your content.

Your Grant of Permission

By uploading, posting, or tagging content that mentions, references, or interacts with St.GABRIEL’s® Pharmaceuticals, our products, our Website, or our social media accounts — including content tagged with #StGabriels, #StGabrielsPharmaceuticals, #TheSerum, #CeramideGuy, or any other St.GABRIEL’s campaign hashtag — you grant St.GABRIEL’s® Pharmaceuticals LLC and its affiliates (collectively, “St.GABRIEL’s”) a worldwide, royalty-free, non-exclusive, transferable right to use your videos, photos, text, reviews, testimonials, and other content (“User Content”), together with your social media handle, username, profile picture, caption, and any location information you included, in any media format including but not limited to:

  • Our website and landing pages
  • Social media pages and accounts (LinkedIn, Instagram, Facebook, Pinterest, TikTok, and others)
  • Email newsletters and marketing communications
  • Digital and print advertising materials
  • Amazon product listings, A+ Content, and Brand Store
  • Third-party retailer websites
  • Presentations, trade shows, and promotional materials

St.GABRIEL’s may use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content for marketing, advertising, educational, and promotional purposes, at our sole discretion.

Your Representations and Warranties

By submitting User Content, you represent and warrant that:

  • You own all rights in and to your User Content, or have obtained all necessary permissions from any rights holders
  • You have permission from any person(s) appearing in your User Content to grant the rights described in these terms
  • You are not a minor (under 18 years of age), or if you are, you have obtained parental or guardian consent
  • Your User Content is a true, accurate, and honest expression of your genuine experience with St.GABRIEL’s products
  • You have disclosed and will disclose receipt of any free products, incentives, or compensation provided in exchange for your User Content, in compliance with FTC guidelines
  • Your User Content does not infringe any third party’s intellectual property rights, rights of privacy, rights of publicity, or any other rights
  • Your User Content does not contain any material that is defamatory, obscene, threatening, abusive, or otherwise unlawful

Release of Liability

You hereby release, discharge, and agree to hold St.GABRIEL’s and any person acting on St.GABRIEL’s behalf harmless from any and all claims, demands, liabilities, damages, and causes of action related in any way to St.GABRIEL’s use of your User Content as described in these terms, including but not limited to any claims based on rights of privacy, rights of publicity, intellectual property rights, or defamation.

Personal Information and Data

You consent to St.GABRIEL’s collection of any personal information you provide in connection with your User Content, and St.GABRIEL’s use and disclosure of that personal information in connection with the use of your User Content as described above. Your personal information may be transferred to or accessible from locations around the world and may be shared with affiliates or trusted third parties working on St.GABRIEL’s behalf.

By posting User Content with any St.GABRIEL’s hashtag or otherwise providing us with personal information, you agree to the collection, use, disclosure, transfer, and processing of your information in accordance with these Permission Terms, our Privacy Policy, and applicable data protection laws and regulations.

Removal Requests

If you would like to request removal of your User Content from our platforms, please contact us at st.gabrielspharmaceuticals@gmail.com with the subject line “User Content Removal Request.” We will make commercially reasonable efforts to remove your content within thirty (30) days of receiving your request, although we cannot guarantee removal from all third-party platforms or cached versions.
